Terms of Service

Clear expectations for website projects and ongoing care.

Last updated: October 13, 2026. These general terms are supplemented by each customer's written project agreement. If an agreed project proposal differs, the signed agreement controls for that project.

1. Website projects and scope

Starter covers one responsive page with standard service and contact information. Business starts at $349 for up to four simple pages. Features, pages, copywriting, photography, e-commerce, booking integrations, custom software, and complex revisions beyond the agreed scope require a separate written quote. One revision round is included unless the project agreement states otherwise. Customers provide or approve their text, images, and business details.

2. Pricing and payment

Projects begin after a 50% deposit and written scope approval. The remaining 50% of the website build price is due after customer approval and before public launch or final handoff. The separate first-month maintenance charge ($15 Starter or $25 Business) is due at launch. For example, a $100 Starter website requires a $50 deposit, $50 website balance, and $15 first-month maintenance, totaling $115. A $349 Business website at its starting price totals $374 including first-month maintenance. Business prices are starting estimates, not guaranteed final quotes. The first three qualifying Starter customers may receive the $100 introductory price; afterward Starter is $130. Applicable taxes, if any, are additional and disclosed before payment.

3. Domains, hosting, and paid services

Customers are responsible for domain registration and renewal fees, as well as any approved third-party services. Free static hosting may be used where suitable, but free tiers and provider policies can change. No paid service will be purchased on the customer's behalf without prior approval. Customers should register their domains in their own names.

4. First month of care

The first month of basic maintenance begins at website launch and is billed separately: $15 for Starter or $25 for Business, due at launch. This first-month fee is not included in the website build price. Subsequent maintenance is optional and does not renew automatically. Before the second month begins, customers choose whether to purchase monthly or annual care; no further care charges occur without their approval. Customers may decline or cancel future care without losing ownership of their website.

5. Maintenance plans and requested work

Annual care begins after the separately billed first month and covers the following 12 months. Annual plans do not automatically renew; renewal requires customer approval.

6. Cancellation and refunds

Clients may cancel future maintenance at any time. Monthly periods already started are not prorated. For prepaid annual care, unused full months are refunded at one-twelfth of the annual price per unused month; partial months are not refunded. For a canceled website build, the client pays for documented work completed through cancellation at the agreed project rate or milestone values in the signed agreement, not exceeding the agreed project fee unless separately approved. Amounts already paid are credited toward that total; any excess is refunded, and any balance is invoiced. No blanket nonrefundable deposit or automatic cancellation penalty applies. Any mandatory rights under applicable law control.

7. Ownership and handoff

After full payment, the customer owns the final website content and custom deliverables created for the project, except licensed third-party assets, software, reusable tools, and components identified in the agreement. The customer retains their own domain. Canceling care does not authorize us to disable, delete, or withhold a fully paid website. We will not intentionally take the site offline merely because maintenance is canceled. The customer may request a reasonable export of their website files and handoff instructions. Website availability still depends on the customer keeping their domain, hosting, and any required third-party services active and paid; where hosting is in our account, the parties will coordinate a reasonable transfer or agree separately on hosting arrangements. We do not promise free indefinite hosting or uninterrupted third-party service.

8. Price changes and loyalty

New project prices may change as the business grows. Already agreed project prices are honored for their defined scope. We aim to preserve existing maintenance rates when sustainable. If a maintenance rate must change, we provide at least 60 days' written notice and an opportunity to cancel before the new rate takes effect. Prepaid annual plans keep their agreed price through the paid term.

9. Timing, approvals, and responsibilities

Project dates depend on timely client materials, access, and feedback. Clients must supply or approve accurate text, images, logos, business claims, and any permissions to use them. We may pause work after an invoice is more than 7 calendar days overdue or essential materials/feedback are more than 14 days overdue, after sending a written reminder. After 30 days of inactivity and a final written notice with at least 7 days to respond, either party may close the unfinished project and settle documented completed work under Section 6. Pausing an unfinished project does not authorize disabling or withholding an unrelated, fully paid live website. Changes in scope or schedule require written agreement. We do not guarantee search rankings, traffic, leads, or sales.

10. Review, acceptance, and handoff

We will provide a reasonable opportunity to review the completed site before launch. The included revision round means one consolidated set of changes within the agreed scope. Clients should report defects or request the included revisions in writing within 7 calendar days after receiving the review link; if there is no response, we will send a reminder and agree on a revised schedule rather than treating silence as automatic approval. Final payment is due after express approval and before launch or handoff. On request after full payment, we will provide a reasonable export of the deliverable files and basic handoff instructions. Future edits and support are separate unless covered by a plan or the 60-day workmanship warranty.

11. Warranty and service limitations

We will perform the agreed services with reasonable care and skill. Except for the 60-day workmanship warranty and any non-waivable legal rights, we do not promise that websites, third-party hosting, email delivery, analytics, or integrations will operate without interruption. Clients should maintain their own account recovery information and backups where applicable. Any liability limitation or dispute procedure must be set out in the signed project agreement and is subject to applicable law; these terms do not waive rights that cannot legally be waived.

12. Privacy and client information

We use inquiry and project contact details to respond, prepare quotes, perform contracted work, invoice, and maintain records. See our Privacy Policy for details about information handling and any third-party services. Each client is responsible for providing any privacy notices or consent mechanisms required for features installed on their own website, unless we separately agree in writing to provide them.

13. Governing law and resolving concerns

For projects contracted with Maier Web Solutions in Louisiana, Louisiana law generally governs to the extent permitted by applicable law. Please contact us first to try to resolve concerns informally. Nothing here requires binding arbitration, removes access to courts, selects an exclusive venue, or waives mandatory consumer rights. Any additional dispute provisions must be expressly agreed in the signed project agreement.
